Rental Terms & Conditions

These terms are important and affect your legal rights and obligations, so please read them and other terms referenced in this document carefully. Each guest must affirm electronically or verbally agreement to these terms and conditions. They are legally binding at the point the reservation is secured by payment. Booking through a 3rd party does not waive SkyRun’s rights under these terms and conditions.

Rental Terms and Conditions

Welcome to SkyRun Rocky Mountain National Park's Terms and Conditions for SkyRun Vacation Rental Properties. These are important and affect your legal rights and obligations, so please read this document carefully. Each guest must affirm electronically to these Rental Terms and Conditions which becomes legally binding at the point the reservation is secured by payment. Booking through a third party does not waive SkyRun Rocky Mountain National Park's rights under these Rental Terms and Conditions.

By submitting this reservation, you are agreeing to the following Rental Terms and Conditions:

LONG TERM RESERVATIONS: Reservations of 14+ days may be subject to additional fees. These fees can only be added after the initial reservation is made. These long-term "mid-stay" fees are listed on the SkyRun web-site property listing and may include trash, hot tub, and/or mid-stay clean services. You will be contacted directly by SkyRun for payment of these fees in order for your reservation to be valid.

Reservations longer than 180 days may require a separate addendum contract to be signed. This addendum will include any additional cancellation and refund policies that specifically apply to reservations longer than 180 days.

PAYMENT POLICY: Short term rental reservations (less than 30 nights) require a prepaid deposit of 33% down to confirm your reservation. The final payment for the balance of your reservation is due 60 days prior to arrival. The complete rental amount (or balance) must be paid in full 60 days prior to arrival.

For reservations over 30 nights, an initial payment of 33% of the first month is due at the time of booking. 30 days before arrival, the balance for the first month will be charged. On guest arrival night, payment for the second month will be charged. One month later, and each month thereafter, the next (future) month will be charged.

CANCELLATION POLICY: We strongly recommend that you secure Travel Insurance to protect your investment. There are a wide variety of sources of Travel Protection available. See the link on our website to contact our preferred supplier of travel Insurance.

Note that the cancellation policy can vary by property, and based on length of stay. Check the cancellation policy on the property you are booking. This is our default cancellation policy.

**100% refund, less booking fee, if canceled at least 61 days prior to arrival date.
**66.67% refund, less booking fee, if canceled at least 31 days prior to arrival date.
**NO REFUNDS for reservations cancelled within 30 days of arrival.

Let us know immediately if you find you are not able to visit us in Estes Park and must cancel your travel plans.

EMERGENCIES and Cancellations: SkyRun will not refund guests for Illness, hospitalization, death, COVID, cancellation of flights, etc. Travel insurance is strongly recommended.

WEATHER and Cancellations: SkyRun will not refund guests for any weather-related issues including but not limited to road conditions, lack of snow, too much snow, or inability to get to the property due to weather or flight delays/cancellations; or issues resulting in weather conditions such as power outages, etc. Travel insurance is strongly recommended.

ENVIRONMENT & SNOW: Snow season in the mountains can happen at any time of the year. Be prepared with adequate vehicles (All Wheel Drive, 4WD, etc.) based on your rental location. We are located in a high mountain alpine environment. Hydration is important to minimize impacts of altitude change. Humidity levels are typically very low year-round. Summer temperatures may average 60-80 degrees, with a few days that reach into higher temperatures, and with a low in the 40-50s. Most properties in Estes Park DO NOT have Air Conditioning (AC), fans are provided for guest comfort. Winter temperatures may vary widely from negative temperatures to 40-50 degrees. Many properties in Estes Park have baseboard heaters which may take several hours to register heat changes.

SNOW AND ICE WILL EXIST ON ALL SURFACES DURING COLD SPELLS. IT IS IMPOSSIBLE IN THE HIGH ALPINE ENVIRONMENT TO PROVIDE A SNOW AND ICE FREE ENVIRONMENT. SNOW AND ICE WILL EXIST ON ROADS, DRIVEWAYS, WALKWAYS, SIDEWALKS, ENTRANCEWAYS, DECKS, STAIRS, PATHS, PATIOS, ROOFS, ETC. TAKE CARE WHILE WALKING, ENTERING AND ACCESSING THE HOME, ENTERING VEHICLES, ETC. TO AVOID SLIPS AND FALLS. BE CAUTIOUS OF ROOF OVERHANGS WHERE SNOW AND ICE BUILD UP AND MAY FALL OR SLIDE.

SNOW PLOWING: Estes Park is NOT an snow and ice free environment. Winter storms can bring many conditions. Who plowing is provided by is determined by the specific rental property. Plowing of driveways will occur when a storm produces more than 4 inches in 24hrs. We cannot guarantee when roads or driveways will be plowed as that is determined by many factors including severity of the storm. You must have a vehicle capable of operating in severe winter conditions as plowing is not guaranteed.

CHECK-IN / CHECK-OUT TIMES: Strict Check-in time: 4:00 pm. Strict Check-out time: 10:00 am. Thank you for courteous adherence to this schedule. If you do not respect these times, you will be charged an extra full day rent for non-compliance.

EARLY DEPARTURES: As reservations are carefully scheduled in advance, no refund will be given if a guest leaves prior to their reserved departure date, regardless of reason.

EXPECTED BEHAVIOR OF RENTERS / GUESTS: We know you want to enjoy the feel and convenience of living in one of our beautiful mountain neighborhoods. However, remember, you are living amongst other peoples. You may be staying next door to a family who live and work in our charming town year round. Thanks in advance for being a good neighbor and thinking twice about loud outside parties, outside activities and/or loud music after the quiet time posted in your vacation rental, and listed on each individual property listing.

AGE RESTRICTIONS: You must be at least 25 years old to rent a property from SkyRun Vacation Rentals. To be sure we are fair with our property owners, a SkyRun Team Member may request verification of this minimum age requirement which will be required, if asked, prior to taking occupancy. If such request is not honored, you will be refused access to the property.

OCCUPANCY RESTRICTIONS: MAXIMUM OCCUPANCY of any SkyRun Vacation Rentals property is equal to the number of people that is advertised on the SkyRun website. As our Guest, you need to be aware that the Town of Estes Park has strict rules and regulations regarding occupancy for vacation rental properties. These rules and regulations are enforced by the local authorities. We, at SkyRun Vacation Rentals, abide by these rules and regulations as a licensed vacation rental property management company and believe it is the best policy to make our Guests aware of such requirements prior to making any reservation.

PARKING: The maximum number of vehicles allowed to be parked at the property is posted on the SkyRun Vacation Rentals website. It is expected that our guests will abide by these parking requirements.

HOT TUBS: Guest use of any hot tub or spa assumes all risks and liability. SkyRun RMNP leaves hot tub temperatures set per manufacturer's instructions, and will not change temperatures upon guest request. Children 12 and under are not allowed in hot tubs. Children 12-18 must be actively supervised by an adult. Guests are advised that there are potential dangers to children who are not carefully supervised, as well as any person using hot tub or spa too long or if a person has health risks, sensitive skin, is intoxicated, using any kind of drugs or medication, or is pregnant. Guests are advised that the chemicals used in the servicing and maintenance of the hot tub can lead to skin and eye irritations, rashes, and other reactions especially in children. Guest agrees to waive any claim whatsoever against SkyRun RMNP, it's owners, contractors, employees, principals, agents, and associated property owners accidents, illness, or injury arising from use of any hot tub or spa. Guest agrees that he/she is responsible and liable for any damages that occur to the hot tub or spa through their or their guest's misuse or negligence. Should guest or guest's guests contaminate the water with any foreign substance by not abiding by the rules, guest agrees to an additional charge of $125.00 to cover the cost to drain, clean and refill the hot tub and remediate the contamination to the filtering system. Each hot tub is serviced prior to arrival and the chemical levels are checked and recorded.

OUTSIDE ACTIVITY LIMITATIONS: As noted previously, our SkyRun Vacation Rentals properties are located in residential neighborhoods. As in any neighborhood, it is expected that outside activities are limited to the property boundaries. To make it easier to determine these limitations, a map of the property boundaries will be posted inside the property in a visible location.

COMMON-USE AREAS & HOAs: Some properties are managed by 3rd party Home Owners Associations (HOAs). These HOAs manage and control shared amenities which include but are not limited to outdoor grills, hot tubs, pool, parking areas, picnic areas and landscaping. Be aware that during non-peak times amenities may be unavailable due to circumstances out of SkyRun control such as building and amenity maintenance or closures. Also, even during peak times HOAs may need to make buildings and amenities unavailable for maintenance and other reasons out of SkyRun control. For no reason will SkyRun provide a refund if amenities are unavailable due to HOA closures or maintenance.

USE OF SPECIFIC PROPERTY BOOKED: You have booked a specific property. However, on extremely rare occasions, the specific property you booked may not be available due to circumstances beyond our control such as maintenance problems with the property, or a change of ownership or management of the property since you booked. In the event that the property you booked is not available, SkyRun Vacation Rentals will attempt to place you in a similar or better property.

If the replacement property offered is not acceptable to you for any reason, SkyRun Vacation Rentals will cancel your reservation and refund your total amount paid. SkyRun Vacation Rentals does not guarantee that a suitable property can be found. If the property you have rented is unable to be occupied during your stay (the furnace breaks, for example), SkyRun Vacation Rentals will make our best effort to find you a similar or better place to move to and if unable to do so, refund the portion of your rent unused.

HOUSEKEEPING, MAINTENANCE: The vacation property will be clean, including fresh linens and towels when you arrive. It will be cleaned after you leave. SkyRun Vacation Rentals units are SELF CATERING. During your stay, you are responsible for any cleaning including bagging and depositing the trash (trash bags are provided) in the designated receptacle. You are welcome to wash linens during your stay. If you want additional towels or linens, mid-stay cleans may be purchased for an additional cost. A mid-stay clean would provide fresh towels, linens, trash take-out and dishwasher loading, with light cleaning.

Authorized personnel may enter the premises if necessary for housekeeping or management of the property.

Estes Park has an active bear population. Do not ever leave any trash outside unless it is in a bear proof trash container. Every property has information on safe trash disposal and information on bear safety. Please carefully read the instructions to bear-proof the property you may be liable for damages caused by a dear due to negligence in not following rules.

DAMAGE, TRASH, & CLEANING: Any excessive damage, excessive cleaning, excessive trash, incidental charges such as added housekeeping may result in additional charges, at the sole discretion of SkyRun RMNP.

DAMAGE WAIVER: Your rental includes a Damage Waiver for accidental damage including any missing or broken items reported prior to check-out. This damage to the rented property covers up to a maximum of $1,500 and will be covered at no further charge to you as long as the damage is reported in writing prior to your departure. Excessive damage may be billed to the guest at the sole discretion of SkyRun RMNP.

SkyRun Vacation Rentals must have a written report of this damage in order to process the claim. Photos are helpful. To provide this report, you may email or call SkyRun Vacation Rentals to notify our team and arrange how the report can be provided in writing prior to check-out. Any damage we deem to be purposeful or negligent or damage not reported will be charged to your credit card. Please report any damage that you notice upon check-in to avoid getting charged for damage you didn't create.

PETS, SMOKING: Smoking is not allowed inside of any property including marijuana and vaping. Smoking may not be allowed outside at some properties. Pets are only allowed at some properties, and this is indicated in the property listing. Pets must be crated when you are away from the property, may not be closed into rooms unless you are in the room, must be on leash when outside, and may not be left home barking. If barking is reported you will need to remove the pet from the home when you can monitor its behavior. You must follow the rules of the home you are in including smoking, pets, noise, parking and common area use. Failure to comply with any rule listed here means an automatic $1000 charge to your credit card for cleaning and/or non-compliance (including house party, see below).

CHECK OUT: Prior to check-out, please make sure that you load and turn on the dishwasher, place wet linens in a bathtub or shower and all trash is securely bagged and placed in the designated receptacle. Close and lock all windows and doors. Leave the heat on as indicated on the property hospitality page. Charges may apply to non-adherence to these instructions.

LOST ITEMS: Any personal item left behind in the property after departure, will be held for 7 days then donated; unless SkyRun is otherwise informed, then said items will be returned to guest at guest expense.

PARTIES: NO HOUSE PARTIES ALLOWED. If there is a party on this property (as evidenced by a noise complaint and/or calling of security or by large amounts of trash and destruction) this rental agreement will be void, you will be asked to leave, and you will be charged for complete clean-up and replacement for damaged items. This will be AT A MINIMUM of $1,000. A party at our vacation properties completely voids the damage waiver. If you intend to come and have a party, rent somewhere else. SkyRun Vacation Rentals is serious about protecting our properties so they will be in perfect condition for our owners and responsible guests.

WARRANTIES: Equipment - From time to time, equipment in the vacation properties (such as utilities, TV's, appliances, hot tubs, etc.) are out of service. In such a case, notify SkyRun Rocky Mountain National Park Vacation Rentals immediately and we will do everything within our power to correct the situation. However, this may not be possible and is not cause for a full or partial refund.

ABUSIVE CONDUCT: SkyRun RMNP does not tolerate abusive conduct towards any of our employees or contractors. Abusive conduct means the intentional conduct that a reasonable person would find hostile or offensive. Abusive conduct may include the infliction of verbal abuse, such as the use of derogatory remarks, insults, and epithets; verbal or physical conduct that a reasonable person would find threatening, intimidating, or humiliating; bullying; or the gratuitous sabotage or undermining of a person's dignity. Every SkyRun employee deserves respect and to work in an environment free of abusive conduct by guests. As a guest, we expect that you will treat our employees and contractors with respect and understanding and not engage in abusive behavior. SkyRun RMNP reserves the right to immediately stop all contact with any guest who is engaging in abusive contact and to remove any guest that is abusive from any SkyRun RMNP managed property. Refusal of any guest to vacate the property once properly notify as a result in abusive behavior will be considered trespassing and we will will notify local authorities.

LIMITATION OF LIABILITY: SkyRun Vacation Rentals assumes no liability for your stay in Colorado or the activities that you take part in while here. The limit of SkyRun Vacation Rentals' liability is the total amount of compensation we have received for your property rental.

VACATION RENTAL REGULATIONS: The Town of Estes Park and the surrounding area is a part of the Estes Valley Planning Area. This property is located within this Planning Area where a number of rules and regulations have been adopted that affect Vacation Home rentals. In the Vacation Rental home you are renting you will find posted the rules you are expected to adhere to.

The rules are as follows:
1. The maximum number of occupants, regardless of age, allowed in the home will be the same as you find in the rental home information on our website. All occupants of this home shall be of one affiliated group or family.
2. The maximum number of vehicles allowed to be parked at this Vacation Home will be the same as you find in the rental home information on our website.
3. Within the Vacation Home, in a prominent location, you will find a map showing the property lines of the property. Please review the property line boundaries and avoid crossing over these lines onto your neighbor's property.
4. Please be respectful of the noise ordinances protecting the Estes Valley.
5. The Estes Valley is a 'dark sky' community. Please turn off all exterior lighting when all of your party is inside the Vacation Home.
6. The Estes Valley is home to a large collection of different wildlife including bears, raccoons and scavenging birds. To protect our special wildlife, please place all garbage in Bear Proof provided trash containers or in an area where cherished critters can't get into mischief, such as a trash enclosure or the garage area. A personalized home instruction book is at each of our vacation rentals to explain the best method for securing trash in that home.
7. Prior to your stay, you must provide, via email, a complete list of guests occupying this vacation rental. This is required by the Town of Estes Park in case of emergency notification.
